Welcome to the www.store.lds.org website (collectively referred to as the “Store”). This website and the information, content, products, and services made available are provided to you by Corporation of the Presiding Bishop of The Church of Jesus Christ of Latter-day Saints, a Utah corporation with its principal offices in Salt Lake City, Utah (“CPB,” “we,” or “us”).

Your use of the Store is governed by these Terms of Use and Sale (“Terms”). By using this Store, establishing a user account with the Store (“LDS Account”), or purchasing products from the Store, you agree to follow and be bound by these Terms. If you disagree with any of the conditions, do not use this Store. These Terms may change from time to time, so please check for changes when you use the Store. Your continued use of the Store following the posting of changes to the conditions constitutes your acceptance to those changes.

General

These Terms constitute a binding legal contract between CPB and you, the LDS Account holder, the user of the Store, and/or the purchaser. These Terms apply to all offers, sales, and purchases from the Store or other websites or mobile applications that link to or reference these Terms.

We attempt to describe the products that are available for purchase through the Store as accurately as possible. However, we do not warrant that the product descriptions, prices, anticipated delivery dates, and representations about availability made or referred to on the Store are accurate, complete, reliable, current, or error free. If a product offered in the Store is not as described, your sole remedy is to return it in unused condition.

While we make every effort to ensure that items appearing on the Store are available, we cannot guarantee that all items are in stock or immediately available when you submit your order. We may reject your order (without liability) for any or no reason in our sole discretion. If this is the case, we will refund any prior payment that you have made for that item.

User Accounts

When using the Store, you may choose to either create an LDS Account to store your information for future visits, or you may check out as a guest. Some items on the Store may only be purchased by individuals who have an LDS Account, and we may require you to meet other criteria. See Store Help for details.

Product Information

Occasionally, there may be information on our Store that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, anticipated delivery dates, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Store is inaccurate at any time without prior notice (including after you have submitted an order via the Store).

Prices and Payment Terms

For customers in the United States and Canada, prices do not include shipping and handling or expedited service fees and these costs will be added to your total price at checkout. For customers outside of the United States and Canada, prices generally include standard shipping. Customers in certain countries may be required to pay value added taxes, sales tax, and customs duties for the products they purchase. 

If the price of a product is obviously incorrect, regardless of whether it is an error in a price posted on the Store or otherwise communicated to you, then we reserve the right, at our sole discretion, to cancel your order and refund to you the amount that you paid, regardless of how the error occurred. A contract between us will only be formed after you have ordered your product(s), you have confirmed your acceptance to these Terms, we have received payment, and we email you confirming the transaction (which is our acceptance of the transaction). We reserve the right to reject or cancel your transaction without reason at any time, provided that if we reject or cancel a transaction after payment has been made, we will return such payment.

Returns and Exchanges

To cancel purchases, to return items, to report damaged or missing items, or to resolve any other questions about your order, including subscriptions, please call Customer Support. For more information about returns and exchanges, please see our Return Policy.

Delivery

The places that we deliver to are listed on the Store ("Territory"). Delivery will be to a valid address within the Territory submitted by you. You must check the delivery address on any order acknowledgement we provide and notify us of errors or omissions as soon as possible. The risk of loss of or damage and title to the products passes to you when the items are delivered to you.

Licenses and Restrictions

All material found at this Store (including visuals, text, icons, displays, databases, media, and general information) is owned or licensed by us. Our rights to the Store, the designs, trademarks, service marks, and other trade names displayed on the Store are our property or the property of our licensors and are protected by copyrights, trademarks, patents, or other proprietary rights and laws. You are granted a nonexclusive, nontransferable, revocable, limited license to view, copy, download, and print material from this Store only for your personal, noncommercial use unless otherwise indicated. Materials may not be reproduced by media personnel for use in traditional public news forums unless otherwise indicated. You may not transmit or distribute material from this Store to other websites or on a computer network without our permission. You may not use this Store or information found at this website for selling or promoting products or services, soliciting clients, or any other commercial purpose.

Notwithstanding the foregoing, we reserve sole discretion and the right to deny, revoke, or limit use of this Store, including reproduction. You may not use any content available via the Store in any other manner or for any other purpose without prior written permission of CPB. It is not our responsibility, however, to determine what “fair use” means for persons wishing to use materials from this site. That remains wholly a responsibility of the user. Furthermore, we are not required to give additional source citations, nor to guarantee that the materials are cleared for alternate uses. Such responsibility also ultimately remains with the user. However, CPB maintains the right to prevent infringement of its materials and to interpret “fair use” as it understands the law.

Trademarks

All trademarks, service marks, logos, and designs used on this Store, whether registered or unregistered, are owned by CPB, other entities institutionally affiliated with The Church of Jesus Christ of Latter-day Saints, or other third parties. You may not use or display any trademarks, service marks, logos, or designs owned by CPB or its affiliates without our prior written consent.

“The Church of Jesus Christ of Latter-day Saints,” “Liahona,” “Book of Mormon,” and “Mormon” are trademarks of Intellectual Reserve, Inc.

Code of Conduct

You agree that you will not individually, or as part of any collective effort, submit or post information to this Store that could be deemed harmful or offensive to other users, nor will you impersonate another user in order to hide your identity or implicate another in such actions. You agree to do nothing that might disrupt the flow of data to and from this Store, impact the service or performance of this Store, or circumvent any of the controls or usage rules that we have implemented. You understand that the result of harmful or offensive actions may include revocation of your right to use this Store and legal action against you.

Your Contact with Third Parties and Other Stores

For your convenience, this Store may contain links to other websites. Unless otherwise indicated, these sites are not maintained or controlled by us, these links do not constitute an endorsement for any linked website, and we are not responsible for their content. Although we have made a good faith effort to link only to tasteful, appropriate sites, some may contain inappropriate or objectionable material. If you find such material while using this Store, please notify us immediately.

Jurisdiction and Applicable Law

These Terms shall be governed by the laws of the state of Utah, United States of America, without giving effect to any principles of conflicts of law. Any action you bring to enforce these Terms or any matters related to this Store shall be brought in either the state or federal courts located in Salt Lake County, Utah, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Limitations of Liability

We are not liable for any special or consequential damages resulting from your use of, or your inability to use, the materials in this site or any linked site, including, but not limited to, lost profits, business interruption, and loss of programs or other data on your information handling system. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this site or any linked site.

Disclaimers

The materials at this site and any linked site are provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, express or implied, including, but not limited to, warranties of title and implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the functions contained at this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or other harmful components.

Miscellaneous

This Store is directed to adults and is not intended for children under the age of 13.

We describe our current practices related to personal information collected from you in our Privacy and Cookie Policy.

You may not share your account password with anyone or use another's account to purchase items from the Store. You are responsible for maintaining the confidentiality of any passwords associated with your LDS Account, monitor all activity under the account, and assume full responsibility for all activities that occur under your account.

CPB may at any time modify, discontinue, or suspend its operation of this website and the Store, or any part thereof, temporarily or permanently, with or without notice to you.

These Terms may change from time to time, so please review them upon submission of each order, even if you have reviewed them before. Your establishment of an LDS Account or your purchase of products or services from the Store constitutes your acceptance to those changes.

CPB may engage the services of subcontractors or agents to assist CPB in the performance of its obligations related to these Terms. You may not assign or transfer your rights under these terms, and any purported assignment or transfer shall be void.

CPB, in its sole discretion, may terminate these Terms with you for any or no cause, at any time, by written notice to you, which shall be effective immediately or as specified in the notice. Notice will be sent to the contact information specified in your LDS Account or provided by you at the time of checkout. After termination, you shall no longer have access to the Store. The provisions of these Terms, which by their intent or meaning are intended to survive such termination, shall continue to apply indefinitely.

This Privacy and Cookie Policy explains how Corporation of the Presiding Bishop of The Church of Jesus Christ of Latter-day Saints, a Utah corporation with its principal offices in Salt Lake City, Utah, and its subsidiaries and affiliates (“CPB,” “we,” or “us”) collect, process, and use information about you when you visit the www.store.lds.org website (the “Store”) and explains when and why cookies (as described below) may be sent to Store visitors.

Information Collected and Utilized 

We may collect or receive information about you when you create your user account (“LDS Account”) or check out as a guest and when you submit information, including, but not limited to, your first and last name, username, password, email address, street address, items purchased and/or stored in your virtual shopping cart, shipping preferences, and messages and emails you send to us. We may store additional information in your LDS Account in order to verify your identity and your eligibility to purchase certain items, such as garments and temple clothing. We may also record actions taken on our Store, including, but not limited to, clicks, page views, IP address, search queries, or your participation in surveys and other information-gathering practices. We may store this information on our equipment or the equipment of third parties that have a relationship with us for that purpose.

Payment information is not stored by this Store and is collected directly by a third party processor through its secure link only to facilitate the transaction. Specifically, no credit card information (including credit card numbers, expiration dates, billing, or other validating information) is transmitted, processed, or stored directly by this Store.

To the extent we retain personal profile information in your LDS Account, you can update your personal information by accessing the LDS Account site and editing (where permitted) your personal profile. Some LDS Account information can only be updated by making changes to the user’s membership records for The Church of Jesus Christ of Latter-day Saints (the “Church”), and such changes must be done in your local LDS ward, branch, or unit.

We may use the information we collect or receive from you to sell you products and address your questions and to manage our everyday business needs, such as to prevent fraud, resolve disputes, improve Store administration, create usage statistics, and comply with the law.

CPB may share customer information with other nonprofit Church affiliated legal entities. In addition, we may provide your personal information to third parties that assist us in completing the transaction, such as service providers that provide payment processing, maintenance, security, data analysis, hosting, or shipping services. These service providers are contractually required to adhere to industry standards in performing these functions and are prohibited from using your personal information for any purpose other than fulfilling our request for services. 

Disclosures

Please be aware that any information you may voluntarily choose to display on any publicly available portion of our Store becomes publicly available and may be collected and used by others.

We may disclose your personal information or other content if required by a subpoena or other judicial or administrative order or otherwise required by law. Additionally, we may disclose your personal information and other information where we deem it appropriate or necessary to prevent a violation of our Terms of Use and Sale or other agreements; to take precautions against liability; to protect the rights, property, or safety of this Store, any individual, or the general public; to maintain and protect the security and integrity of our services or infrastructure; to protect ourselves and our services from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against third party claims or allegations; or to assist government enforcement agencies.

We may use other companies to perform services necessary to our operations. In the course of providing these services, those companies may have access to your personal information. By contractual agreement, those companies must treat your information safely. However, we will not be liable (to the fullest extent permitted by law) for any damages that may result from the misuse of your personal information by these companies.

Cookies and Clear GIFs

“Cookies” are pieces of information that a website transfers to an individual’s hard drive or other website-browsing equipment for record-keeping purposes. Cookies allow the website to remember important information that will make your use of the site more convenient. A cookie will typically contain the name of the domain from which the cookie came, the “lifetime” of the cookie, and a randomly generated unique number or other value. Like most websites, we use cookies for a variety of purposes in order to improve your online experience. Clear GIFs and two types of cookies are used on this website:

• Session cookies are temporary cookies that remain in the cookie folder of your browser until you leave the site.
• Persistent cookies remain in the cookie file of your browser for much longer (though how long will depend on the lifetime of the specific cookie).
• A clear GIF is a graphic file, rather than a text file, that is similar in function to a cookie.

When we use session cookies to track the total number of visitors to our site, this is done on an anonymous aggregate basis (as cookies do not in themselves carry any personal data). We may also employ cookies so that we remember your computer when it is used to return to the site to help customize your customer experience. We may associate personal information with a cookie file in those instances.

Please note that we are unable to offer our Store without placing some of our own cookies and/or similar technologies on your device. International Transfer of Data

Any personal information provided to us may be received at or transferred to our servers located in the United States of America, which may have less stringent data protection laws than the country where you reside. When you submit information through this Store, you understand that your action is an affirmative act, indicating your informed consent to the processing, as well as your informed consent to allow for the transborder data transfer to the United States of America for the purposes outlined above. If you submit any personal information about yourself or others, including information referring or demonstrating religious beliefs, affiliations, or practices, then you alone are responsible for the consequences of making this transfer of personal information.

Return and Exchange Period

All items, other than annual curriculum items, must be returned or exchanged within 90 calendar days after the date you received the item. Annual curriculum items must be returned or exchanged by the later of (i) the last day of March or (ii) 90 calendar days after the date you received the items.

How to Return or Exchange an Item

To return or exchange an item you ordered online or over the phone, please contact Customer Support for instructions and to obtain a return authorization number. You may return or exchange an item by mail, or, if the item is sold at your local distribution store, the distribution store, in its sole discretion, may agree to receive the item. However, if you return an item to a distribution store, the amount of your refund will be limited to the current selling price of that item in the store and will be issued in accordance with the refund policy described below.

Unless we made an error with your order or we provide you with a return label, you will be required to pay return shipping for your return or exchange. All returns must be accompanied by the original packing slip.

Unless a product is defective, returns and exchanges will be accepted only if:

• The item is in new condition;
• The item is returned with all original packaging and accessories;
• Media items (for example, music and movies) are unopened and still in their plastic wrap;
• Clothing is unworn; and
• Garments are unopened.

Refunds

Refunds will generally be issued in the same method and currency of payment as the original payment, but we may choose, in our sole discretion, to issue refunds in another form or currency as we deem appropriate. If you return an item purchased online or over the phone to a distribution store, the amount of your refund will be limited to the current selling price of that item in the distribution store.

Defective, Damaged, or Missing Items

If an item you ordered is defective, damaged during shipping, or does not arrive, we will replace the item at no cost to you. Please contact Customer Support to arrange for a replacement. Requests to replace defective, damaged, or missing items must be made within 90 calendar days of the day you ordered the item.

For food storage items, refunds or replacements will only be given for the portion of the order that is damaged.

Personalized or Customized Items

Unless there was an error with your order, items that have been personalized or customized may not be returned or exchanged.

Garments

Only garments in unopened packages can be returned except in the case of a product defect. If you are unsure of your size, test the fit with one item before opening others. Please contact Customer Support if you receive defective garments.

Magazines

Please contact Customer Support if you do not receive an issue of a magazine or if you are not satisfied with your magazine purchase. Under certain circumstances, the magazine subscription can be canceled and a refund received for any remaining issues.
